A divided Ninth U.S. Circuit Court of Appeals held yesterday that a habeas corpus petition—asserting that the defendant’s Sixth Amendment right to be informed of the nature of the charges against him was violated by a failure to allege in the charging documents facts necessary to the imposition of a heightened sentence—was properly denied in a kidnapping-for-ransom case that left a victim permanently mutilated.

Gutierrez is expected to decide whether the one-year statute of limitations in the Medical Injury Compensation Reform Act (MICRA; Code Civ. Proc., § 340.5) applies to a personal injury claim alleging that the plaintiff’s vehicle was struck by a negligently driven ambulance.

Delaying the NextGen UBE, which stands for Uniform Bar Exam, until July 2027 would give the National Conference of Bar Examiners more time to test the exam technology, said Nachman Gutowski, president of the Association of Academic Support Professionals, which represents law school bar prep faculty.
