• ABA: Law schools must adopt policies consistent with 1st Amendment

    (Subscription required) The new requirement forbids conduct that “hinders” free expression by “substantially interfering” with classes, meetings, interviews, ceremonies and public events. It allows law schools to restrict expression that violates the law, defames a specific individual, threatens and harrasses, and violates privacy and confidentiality.

Garrett of Jones Day — argued in their motion that the plaintiffs’ last remaining claim for age discrimination under the Fair Employment Housing Act must be dismissed because the Judicial Council never actually enforced the 1,320-day limit on judges’ participation in the program.
