Supreme Court finds Legislature has broadly displaced common law for homeowner construction defect claims

In McMillin Albany LLC v. Superior Court, the Supreme Court today holds that the 2002 Right to Repair Act is “virtually [the] exclusive remedy not just for economic loss but also for property damage arising from construction defects” in homeowner lawsuits.

President Trump’s administration asked the U.S. Supreme Court late Thursday to allow Trump to abolish a program protecting nearly 700,000 young, undocumented immigrants from deportation, arguing that a federal appeals court should be bypassed because “time is of the essence.”
